1.  INTRODUCTION

1.1 These Terms of Service (“Terms”) constitute a legally binding agreement between you the client (“you”, “your”, “Customer”) and Chaos Cartel (“we”, “us”, “our”, “Chaos Cartel”).

1.2 These Terms govern your access to and use of www.chaoscartel.com.au (the “Site”) and any purchase of products from us.

1.3 By accessing the Site or placing an order, you agree to be legally bound by these Terms. If you do not agree, you must immediately cease use of the Site.

 

2. INTERPRETATION

2.1 In these Terms:

“ACL” means the Australian Consumer Law contained in Schedule 2 of the Competition and Consumer Act 2010

“Agreement” means these Terms together with any policies referenced (including Shipping, Returns, Privacy Policy and Accessibility)

“Customer”, “you”, “your” means any person accessing the Site or purchasing Products

“Order” means a request submitted by you to purchase Products via the Site

“Products” means any goods sold by Chaos Cartel via the Site

“Site” means www.chaoscartel.com.au

“Services” means the provision of the Site and sale of Products

“Title” means ownership. 

2.2 Headings are for convenience only and do not affect interpretation.

2.3 Words in singular include plural and vice versa.

 

3. ELIGIBILITY

3.1 You must be at least 18 years old or have the consent of a parent or legal guardian.

3.2 You warrant that all information provided is true, accurate, and complete.

3.3 Chaos Cartel will acknowledge any order place with information warranted by the customer as acceptance they are legally capable of entering into a binding contract.

3.4 Chaos Cartel will not contract with minors or any persons in breach of clause 3.

4. ORDERS AND SUPPLY OF GOODS

4.1 By placing an Order, you make an offer to purchase Products under these Terms of Service.

4.2 A legally binding contract between you and Chaos Cartel is formed only when we accept your Order, which occurs when we issue a confirmation email, dispatch confirmation or any form of communication representing we have received your order. 

4.3 We reserve the right to refuse or cancel any Order at our discretion prior to acceptance, including where there are:

(a) pricing or technical errors;

(b) stock unavailability;

(c) suspected fraudulent or unauthorised transactions.

4.4 We make reasonable efforts to ensure that all Products are accurately represented on the Site, including descriptions, images, and colours. However:

(a) images are provided for illustrative purposes only;

(b) colours and appearance may vary due to screen settings, lighting, and device display differences;

(c) minor variations between the Product and its online representation may occur.

4.5 To the maximum extent permitted by law, such variations do not constitute a defect or fault, subject to your rights under the Australian Consumer Law.

4.6 We are committed to providing Products of a high standard and take reasonable steps to ensure that all Products meet our quality expectations prior to dispatch.

4.7 While we stand behind the quality of our Products, all purchases remain subject to the consumer guarantees under the Australian Consumer Law, which provide protections where goods are not of acceptable quality, fit for purpose, or match their description.

4.8 Except as required under the Australian Consumer Law, we do not provide any additional warranties or guarantees beyond those expressly set out in these Terms.

 

5. PRICING AND PAYMENT

5.1 All prices are in AUD and may change without notice.

5.2 Payment must be made in full at checkout via secure third-party providers, including Stripe integrated through Wix.

5.3 By submitting payment details, you authorise us to charge the total amount of your Order.

5.4 If a pricing error occurs, we may cancel the Order and provide a refund or allow you to proceed at the corrected price.

 

6. SHIPPING AND DELIVERY

6.1 Shipping is governed by our Shipping Policy.

6.2 Delivery timeframes are estimates only and not guaranteed.

6.3 We are not liable for delays caused by carriers, customs, or force majeure events beyond our control.

6.4 International orders may incur customs duties and taxes, which are your responsibility.

6.5 Orders will be delivered to the location instructed by the customer as the parties agree to the “Delivery Location”. 

6.6 The onus is on the customer to provide accurate and correct information regarding delivery location, any inconsistencies or errors in information made by the customer will not be liable by Chaos Cartel. 

 

7. RISK AND TITLE

7.1 Risk in the Products passes to you upon delivery to your nominated address.

7.2 Title (ownership) in the Products passes to you once full payment has been received.

7.3 Nothing in this clause excludes or limits your rights under the Australian Consumer Law, including where goods are lost or damaged in transit.

 

8. RETURNS AND EXCHANGE

8.1 Returns are governed by our Returns & Exchanges Policy.

8.2 We do not provide refunds for change of mind.

8.3 Returns must comply with strict eligibility requirements, including that Products are in resalable condition as determined by Chaos Cartel.

8.4 Final sale items are not eligible for return or exchange.

8.5 This clause is subject to your rights under the ACL.

 

9. CONSUMER GUARANTEES (ACL)

9.1 Nothing in these Terms excludes, restricts, or modifies your rights under the ACL.

9.2 Our Products come with guarantees that cannot be excluded under law.

9.3 If a Product has a major failure, you are entitled to a refund or replacement.

9.4 For minor failures, we may repair or replace the Product within a reasonable time.

 

10. USE OF WEBSITE

10.1 You must not:

(a) use the Site for unlawful purposes;

(b) interfere with or disrupt the Site;

(c) attempt unauthorised access;

(d) use automated systems (bots, scraping, etc.).

10.2 We may suspend or terminate access for any breach.

10.3 Your use of the Site is also governed by our Privacy Policy, which outlines how we collect, use, disclose, and store your personal information.

10.4 By using the Site or placing an Order, you consent to the collection and use of your personal information in accordance with our Privacy Policy.

10.5 We take reasonable steps to protect your personal information in accordance with the Privacy Act 1988 and the Australian Privacy Principles.

 

11. INTELLECTUAL PROPERTY

11.1 All content on the Site is the exclusive property of Chaos Cartel.

11.2 You must not copy, reproduce, distribute, or exploit any content without prior written consent.

 

12. THIRD-PARTY SERVICES

12.1 The Site uses third-party services, including Wix and payment providers such as Stripe.

12.2 We are not responsible for the acts or omissions of third parties.

13. LIMITATION OF LIABILITY

13.1 To the maximum extent permitted by law:

(a) we exclude liability for indirect or consequential loss;

(b) our total liability is limited to the amount paid for the Product.

13.2 This clause does not apply where liability cannot be excluded under the ACL.

 

14. INDEMNITY

14.1 You agree to indemnify and hold harmless Chaos Cartel from any claims arising from:

(a) your breach of these Terms;

(b) misuse of the Site;

(c) violation of any law or third-party rights.

 

15. CHANGES TO TERMS

15.1 We may update or modify these Terms and any related policies (including Shipping, Returns, Privacy Policy and Accessibility) at any time without prior notice.

15.2 The most current version of these Terms will always be available on the Site.

15.3 It is your responsibility to review these Terms and policies prior to placing an Order to ensure you understand the terms that apply at that time.

15.4 By continuing to access or use the Site, or by placing an Order after any updates are published, you agree to be bound by the updated Terms.

15.5 We reserve the right to correct any errors, inaccuracies, or omissions at any time without notice.

15.6 This includes after an Order has been submitted.

 

16. TERMINATION

16.1 These Terms remain in effect unless terminated by you or us.

16.2 We may terminate or suspend access immediately if you breach these Terms.

16.3 Obligations and liabilities incurred prior to termination survive termination.

 

17. ENTIRE AGREEMENT

17.1 These Terms, together with our policies, constitute the entire agreement between you and Chaos Cartel.

17.2 They supersede all prior agreements or communications.

17.3 These Terms are governed by the laws of Victoria, Australia.
